Terms and Conditions

All products and services (“Service”) provided by Optoma are subject to this Terms and Conditions of Use (“Terms”). Please read the Terms carefully before accessing, using or obtaining any materials, information, products or services of the Service. The Terms constitute a legal agreement between you and Optoma and govern all use of the Service, including all content, information, and services. By accessing, the Optoma Service, or any other feature or other Optoma platform, you are confirming that you have read, understood and agreed to the Terms and our Privacy Policy. We may update the Terms and Privacy Policy at any time, with or without notice to you. Each time you access the Service, you agree to be bound by the Terms then in effect.

You may only use the Service in compliance with applicable laws and for legitimate purposes. In consideration of you agreeing to abide by the Terms, we grant you a non-transferable, non-exclusive license to download, access, and use the Service. In particular, we grant such license to you subject to you agreeing that you shall not:

  • 1. use the Service for any purpose that is improper, unlawful, or to post, share or transmit any material that
    • (1) is defamatory, offensive, obscene or otherwise objectionable;
    • (2) is in breach of confidence or privacy or of any third party’s rights including copyright, trademark or other intellectual property rights;
    • (3) is posted, shared or transmitted for the purpose of advertising or promoting yourself or any third party; or
    • (4) is misleading or misrepresentative as to your identity or which in any way suggests that you are sponsored, affiliated or connected with Optoma;
  • 2. use the Service in any manner which may cause damage to Optoma or bring Optoma into disrepute;
  • 3. disassemble, reverse engineer or otherwise decompile any software, applications, updates or hardware contained in or available via the Service, except as permitted by law;
  • 4. copy, distribute, communicate to the public, sell, rent, lend or otherwise use the Service or seek to violate or circumvent any security measures employed to prevent or limit your access to or use of the Service;
  • 5. use or interfere with the Service in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users;
  • 6. introduce onto, or transmit via, the Service any disruptive computer program code, virus, denial of service or spam attack, worm, Trojan horse, authorization key, license control utility or software lock;
  • 7. remove, alter or replace any notices of authorship, trademarks, business names, logos or other designations of origin on the Service or pass off or attempt to pass off the Service as the product of anyone other than Optoma;
  • 8. use any automated computer program or application to scan, copy, index, sort or otherwise exploit the Service or any part thereof. Except for the limited license set forth in the Terms, Optoma does not grant you any express or implied rights or licenses under any patents, trademarks, copyrights, or other proprietary or intellectual property rights.

Optoma is not the owner of the materials you post, upload, input or submit to any Service provided by Optoma. By posting, uploading, inputting, providing or submitting any materials, you warrant and represent that you own or otherwise control all of the rights to your materials including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the materials. By posting, uploading, inputting, providing or submitting your materials, you are granting Optoma, our affiliates, business partners, service providers, third parties in connection with providing Service your permission to use your materials in connection with the Service. No compensation will be paid with respect to the use of your materials, as provided herein. Optoma is under no obligation to post or use any materials you may provide and Optoma may remove any materials at any time in our sole discretion.

Optoma provides the Service “AS IS”, without warranty of any kind, express or implied, including, but not limited to:warranties of performance, merchantability, fitness for a particular purpose, accuracy, omissions, completeness and delays; warranties that access to any product will be uninterrupted, secure, complete, or error free; and warranties with regard to any content or software that has been modified in any way by anyone other than, and without the express approval of Optoma. By accessing, browsing, or using the Service, you acknowledge that provision of content and software are entails the likelihood of some human and machine errors, delays, interruptions, and losses, including the inadvertent loss of data or damage to media; and the Service and the products and services referenced herein may not satisfy your requirements not expressly stated in the agreements between you and Optoma. In no event will Optoma be liable, in contract, tort, strict liability, or otherwise, for indirect, incidental, special, punitive, or consequential damages of any kind arising out of, or in connection with use of the Service, whether or not Optoma has been advised of the possibility of such damage; any claims relating in any way to your inability or failure to perform work or to perform such work properly or completely, even if assisted by Optoma; or any decision made or action taken by you in reliance upon the availability of or content made available through the Service.

You agree to indemnify, defend and hold Optoma, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the Service harmless from and against all claims, losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of the Terms by you.

Optoma reserves the right to change the Terms at any time. Updated versions of the Terms will be effective immediately. You are responsible for regularly reviewing the Terms on Optoma’s website. Continued use of the Service after any such changes constitutes your consent to such changes.
